What dictates if I have the "Data Colors" option available?

I have two reports built, and they have what in my eyes is similar data: locations, customer types, sales data tec. On one I have the option on the formatting tab to adjust: data colors, category labels, title, backgound. On the other I have legend, category lables, title, and background.

What cuases the option for "data colors" vs. "legend"?

Except for Title and Background, which are generally consistent, options are defined on a chart by chart basis.
