This might be an easy questions to answer based on which liscense I have. When I'm in the service and looking at my workspaces, I don't see the publish to apps button in the upper right of the screen. Is this because I don't have a premium license? I currently have a pro license.

From the screenshot you provided, I infer that you are a Contributor of a New App Workspace. Please check.
If you are a Contributor of a New App Workspace, you will have no access to publish app.

could it be that you're in My Workspace? Because Apps are only available in regular/group workspaces.
@nickyvv I checked another workspace and its doing the same thing. I'm assuming this could be a permissions issue since I don't even see the toggle to include in app on the right hand side.

correct, to be able to publish an app you have to be at least a Member or Admin. And from your picture I think I see this is an "old workspace", where you don't have the Contributor or Viewer role yet. So it's only Members can edit or Members can view content. If you click on Settings you can check that in the workspace.
Have a look at the Roles in the new workspace.
@nickyvv can you explain what you mean by old workspace? Here are screen shots of the settings. I'm not sure what I'm looking for.
